If you are doing that for an American then you are breaking several laws, more importantly so is the American and he is definitely in contravention of his broker agreement.

If you are using clients funds as loans to trade I have a suspicion you are breaking international money laundering laws. Ohhhhh man, I so wouldn't do that...

In O's agreement they specifically ask if anyone has a financial interest in the account other than the owner, if the answer is yes, they are obliged to report you. I wanted to open one for my mom and put some money into it for her, they freaked out completely.

This is not a slap on the wrist stuff for you or for him if they catch you. Decades mate. You will spend the rest of your life in jail if someone picks it up and decide to come after you or your client. And to put that information on a board like this...

Read that quote I did again. As of 2013 it will be illegal for an international company that is not registered in the Eurozone to solicit clients in the Eurozone. Tax havens not going to help you with nothing. And as far as I understand it that is already the case in USA. It's part of the liquidity agreements with the brokers, so if the broker picks up on this kiss that account good bye and expect to be reported to the relevant authorities.

As for the PAMM accounts, I don't use MT for that on Oanda nor can MT pick up my trades. I have to use the third party API they provide to send data out. And they don't allow it for registered fxmanagers.

Ya, so I don't really play the system like real men do as you say, and try this or that to make a few cents. The couple of bucks just isn't worth the years of legal wrangle if you get caught and/or jail time. You're scratching the lions ball with a short stick on that one.

Look I'm not a lawyer, but I was on skype yesterday or the day before with someone who has one of those special European banking licenses. And he's having trouble! That's why I know, this guy runs a small European fund from an offshore jurisdiction. He hasn't been able to legally take Americans for some time now and now he's losing Europe as well unless he opens a office and incurs the expense of doing so.

My guess would be all the fancy foot work is actually highly illegal and would carry stiff penalties if not jail. Not a road I'm prepared to go down.

But of course I'm not a real man. Only have one of the most dangerous jobs on the planet.

Well if some of your friend lend you money via agreement without interest, its up to you what you will do with this money in my country, you can buy bike, computer, trow it into trashbin, or put it into bank.
Important is only date when you will have to pay it back.

BTW Oanda or other brooker dont have chance to know if you putting your money into account or money from someone else.
There are no names printed on money.

But I agree with you and american laws I am happy that I am not american and I am living in country where freedom is not only word on propaganda material. Oh we dont even accepted ACTA PIPA, we dont have to give our passwords to authorities and so ... you should reconsider to change your citizenship/nationality :)

Well, see right there is the issue. There is in fact names printed on money. It always belongs to someone and has for the most part unless it's cash, traceable origins. And if it is cash then banks are required to report it.

I would not play this game. It's not necessary and it is risky.

I tend to do things the legal way. But I will amend my statement.

For those who wish to run legal businesses and conduct their accounts within their broker agreements PAMM will be a thing of the past by end 2013 in most of the world.

You dont need to run PAMM account for PAMM system.
And you can trade on whatever brooker you want. Just register as company in tax heaven like everybody do and use your company name with brooker.

Here you can see some PAMM systems ran on OANDA on personal accounts (not mine, but i know this guy from somewhere(not important). Its just for example

You dont need to pay $$$ for worhless license which doest mean nothing.
Istead of it, secure your clients with loan agreements like real men do.

PS: sometimes maybe some of your arguments are valid but with childish acting they are worth nothing.

Balance still pretty high, but equity seems to be close to zero.

Ja - I haven't really looked, for the most part what other people do doesn't really bother me. Just that 'easy 25%' really got up my nose, especially you got $50 bucks to back up the claim and 2 weeks wafting.

Waiting for that thing to blow up so I can have a little ' I told you so' party and post the picks.

It's not going to get any better, it's going to get worse, a lot worse. The governments are clamping down and desperate for cash, any cash. They will nail your balls to the wall for 3 cents mate.

Doesn't help to try fiddle the system with fancy footwork, get it wrong and it's jail time. And in 2 years if you sneeze you'll have the sneeze police on you in seconds.

PAMM is going to disappear in all countries and it's going to come from the liquidity providers who will not provide liquidity to the broker unless they ensure legal compliance, break that and the broker will report you if they find out.

PAMM is no longer an option for someone who wants to build an fx business. It's gone, finished. Trading direct or otherwise. I just told someone with the right paperwork is having issues, now you want to tell me it's no hassle without the paper work ? It's going to be very difficult to have clients going forward.

And I'll tell you another thing which will make you double over with laughter. They going to move fx trading away from the banks.

Think about that for a few seconds.

And then ask yourself why did Oanda open an office close to the CME ? Got much bigger problems on the horizon than PAMM accounts mate, much bigger.
