Forex taxes in Belgium

Hi Members of MyFxBook.
Does someone of you know a forextrader/ EA user from Belgium? My plan is to invest a % of my capital into forex EA's, forex manual traders AND trading forex myself BUT the taxrules in Belgium about forex are very limited and vague. I allready asked it to my taxadvisor and even he couldn't give me a 100% correct answer about forextaxes in Belgium. So I am searching belgian people who can help me with their experiences with taxes on forextrading.
I hope someone out there can help me. I would be very grateful

I am living in Belgium and have been trading forex now for 3 years, last year i traded break even and this year i haven't traded much.
As for your question about taxrules in Belgium, i also don't know much about it, but i can tell you that i traded for approximately over €10.000 and never had any tax problems nor any question about my wins and profits that i made with forex.
But i have to tell you that i did my withdrawals with moneybrookers and not true a Belgian bank account.
I hope my experience could help you.

I am also living in Belgium and annoyed by how little literature is available on the internet on tax treatment of Fx trading profit in Belgium.
In the meanwhile were you able to find out more on this subject?

From what I know if your profits are over 20k/year revenue are suppose to be informed,but there is no data available on what rate they Tax if they actually do decide,at the moment there are no set tax rules on spread betting in UK&IRE.A great business to be in with 0 Tax,I think its because of the figures that 95% lose within a short period,but what about the 5% that win over the long run.

I can't say for sure, but as Belgium impose no capital gains taxes on stocks (from what i can gather, it is only imposed on real estate), I suppose they won't tax forex as it is a form of capital gains too.

It could be taxed if forex trading is your only business/income - need to be checked thou...

maybe income tax if its your only activity but as some members of the forum stated in Belgium you don't pay capital gains tax unlike the UK. I have the appointed in 12 days will update you on what my bank manager states.

I have similar questions for the Netherlands as I recently moved over with my wife. From the information I collected so far, I understand that the profit will be taxed. Now I wonder if it is handy to open a Dutch company and will there be a difference in total taxation in case of trading via a limited liability company?

Okay, I have read this thread once again and what you all have decided really with that ? What do we do honestly? I hope something could really be done with that matter a bit later. Somebody says they tax capital gains - some that are not.

@Doombinder i would advise that you make an appointment with Service Publique Finance they should be able to answer your question, it is indeed true that in Belgium there is no capital gains with the exception if the value exceeds 500k of assets such as stocks.
The rules are difficult as forex is considered as speculative and i am not mistake it also depends how many trades you place daily/weekly but i am no expert its best to consult with the SPF, if you ever get to talk to them let me know as i would be curious on what they state.

Forex taxes in Belgium are very complicated. You can get an idea about the taxes by just reading the Forex tax in Belgium Wikipedia article, but there is more to it than that.
